Lindsay Lohan is no New Yorker says Pitbull

Pitbull is playing hardball in Lindsay Lohan‘s lawsuit against him. The rapper wants the case’s venue changed in a move that would give him an advantage.

Lindsay Lohan is suing Pitbull for defamation in a New York state court over the use of her name in one of his songs — but the hip hop artist is calling foul.

Pitbull is asking for a change of venue to a federal court because he says she isn’t a New York resident and hasn’t been for years. His lawyers say she has been a California resident since she moved to the west coast in 2004, when she was just 18 years old.

“In light of Ms. Lohan’s continuing obligations to the State of California, as well as the foregoing facts, Ms. Lohan is a citizen of California, not New York,” states the docs filed by Pitbull’s legal team. “As a result of Ms. Lohan’s subsequent California 2011 jail sentence and revocation of parole, her ties to California have only increased.”

The lawyers say federal court is a more appropriate place for this case to be tried, which could be a better bet for the musician.

Lohan is suing Pitbull for $75,000 over lyrics in his song “Give Me Everything” which say, “I got it locked up like Lindsay Lohan” — an obvious reference to her jail stints, as short as they have been.

Pitbull has since apologized for offending Lohan but asserts she has no legal claim.
